1. Acceptance of Terms

By accessing and using the services of Fit Trackers California ("we," "our," or "us"), you ("member," "you," or "your") agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our facilities or services.

2. Membership Agreement

2.1 Membership Types

We offer various membership types including Basic, Premium, and VIP memberships. Each membership type has specific benefits and restrictions as outlined in our membership materials.

2.2 Membership Duration

Memberships are offered on a monthly basis unless otherwise specified. All memberships automatically renew unless cancelled according to our cancellation policy.

2.3 Membership Fees

Membership fees are due monthly in advance. A one-time joining fee may apply for new members. All fees are non-refundable except as required by UAE law.

3. Facility Rules and Regulations

3.1 Operating Hours

Our facility operates according to posted hours. Hours may vary during holidays and special events. VIP members may have extended access hours.

3.2 Proper Attire

Appropriate athletic attire and closed-toe shoes are required at all times. We reserve the right to refuse entry to improperly dressed individuals.

3.3 Equipment Usage

Members must use equipment properly and safely. Time limits may apply during peak hours. Members are responsible for cleaning equipment after use.

3.4 Personal Belongings

Fit Trackers is not responsible for lost, stolen, or damaged personal items. Use of lockers is at your own risk.

4. Health and Safety

4.1 Health Declaration

Members must declare their fitness for physical exercise. We recommend consulting with a physician before beginning any exercise program.

4.2 Assumption of Risk

Exercise involves inherent risks. Members participate at their own risk and assume full responsibility for any injuries or health issues that may occur.

4.3 Medical Emergencies

In case of medical emergency, we will provide reasonable assistance and may contact emergency services. Members are responsible for their own medical expenses.

5. Cancellation and Suspension

5.1 Membership Cancellation

Members may cancel their membership with 30 days written notice. Cancellation must be submitted in writing to our membership department.

5.2 Membership Suspension

We reserve the right to suspend or terminate memberships for violation of rules, non-payment, or inappropriate behavior.

5.3 Membership Freeze

Members may freeze their membership for medical reasons or extended travel with proper documentation. Administrative fees may apply.

6. Personal Training Services

6.1 Trainer Qualifications

All personal trainers are certified professionals. However, members should inform trainers of any health conditions or limitations.

6.2 Session Policies

Personal training sessions must be cancelled at least 24 hours in advance to avoid charges. No-shows will be charged the full session fee.

7. Privacy and Data Protection

We collect and use personal information in accordance with our Privacy Policy and UAE data protection laws. Member information is kept confidential and secure.

8. Liability and Indemnification

8.1 Limitation of Liability

Fit Trackers's liability is limited to the maximum extent permitted by UAE law. We are not liable for indirect, incidental, or consequential damages.

8.2 Member Indemnification

Members agree to indemnify and hold harmless Fit Trackers from any claims arising from their use of our facilities or services.

9. Intellectual Property

All content, trademarks, and materials on our premises and website are the property of Fit Trackers. Unauthorized use is prohibited.

10. Photography and Media

By entering our facility, members consent to being photographed or filmed for promotional purposes unless they specifically opt out in writing.

11. Guest Policy

Members may bring guests according to their membership level. Guests must sign waivers and follow all facility rules. Guest fees may apply.

12. Dispute Resolution

Any disputes will be resolved through mediation or arbitration in California, UAE, according to UAE law. Members waive the right to class action lawsuits.

13. Modifications to Terms

We reserve the right to modify these terms at any time. Members will be notified of significant changes via email or posted notices.

14. Governing Law

These terms are governed by the laws of the United Arab Emirates and the Emirate of California.
